Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and DC Labs, LLC (“we,” “us,” or “our”), which operates ASND at asndfitness.com and app.asndfitness.com (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Who can use ASND

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your login details secure and for everything that happens under your account. Give us accurate information and tell us at support@asndfitness.com if you think someone else has accessed your account.

What ASND is

ASND is a tool for tracking your own fitness: meal plans, workouts, cardio, daily logs, check-ins, progress photos, bloodwork, and supplements. It includes Magnus, an AI coach that answers questions using the information in your account. Features may change, and we may add, change, or remove features at any time.

Not medical advice

ASND does not provide medical advice, diagnosis, or treatment. Everything in the Service, including meal plans, nutrition targets, workouts, supplement and peptide information, bloodwork reference ranges, and AI coach replies, is for general informational and tracking purposes only. It is not a substitute for advice from a doctor or other qualified healthcare professional.

Talk to your doctor before starting any diet, exercise program, supplement, or peptide, especially if you have a medical condition, take medication, or are pregnant or nursing. Stop exercising and seek medical help if you feel pain, dizziness, or shortness of breath. Never ignore professional medical advice or delay seeking it because of something you saw in ASND. If you think you have a medical emergency, call 911 or your local emergency number.

Exercise, dietary changes, supplements, and peptides carry real risks, including injury. You choose whether and how to act on anything in the Service, and you take on those risks yourself.

Peptides, supplements, and partner products

ASND does not sell, make, or ship peptides, supplements, or any other product. Some links take you to third-party sellers, such as PS Peptides and Amazon. Those purchases are between you and the seller, under the seller's terms, and we are not responsible for their products, quality, shipping, or claims.

Many peptides are sold as research compounds and are not approved by the U.S. Food and Drug Administration for human use. Information about peptides or doses in the Service is not a recommendation or prescription. Laws about these products vary, and you are responsible for following the laws where you live.

Some links are affiliate or referral links, which means we may earn a commission if you make a purchase. As an Amazon Associate we earn from qualifying purchases.

AI coach

Magnus replies are generated by artificial intelligence. They can be incomplete, out of date, or wrong, and they are not reviewed by a person before you see them. Use your own judgment and check anything important with a qualified professional. Do not rely on the AI coach for medical, emergency, or safety decisions.

Your content

You own the information you put into ASND, including your logs, photos, and files (“Your Content”). You give us permission to store, process, and display Your Content only as needed to run and improve the Service for you, as described in our Privacy Policy. You confirm you have the right to upload Your Content and that it does not violate anyone else's rights.

Acceptable use

When using ASND, you agree not to:

• Break the law or help anyone else break it
• Access someone else's account or data, or try to get around our security
• Upload content that is illegal, harmful, or that you do not have the right to share
• Interfere with the Service, overload it, or use bots or scrapers to access it
• Copy, resell, or reverse engineer the Service, or use it to build a competing product

Fees

ASND is currently free to use. If we introduce paid features, we will show the price and terms before you are charged, and you will not be charged without agreeing first.

Our property

The Service, including its design, software, text, graphics, and the ASND name and logo, belongs to DC Labs, LLC and is protected by law. These Terms give you a personal, non-transferable right to use the Service for your own fitness tracking, and nothing more.

Ending your account

You can stop using ASND at any time and ask us to delete your account by emailing support@asndfitness.com. We may suspend or close your account if you break these Terms, if required by law, or if we stop offering the Service. Sections that by their nature should continue after your account ends, such as disclaimers, limits on liability, and indemnification, will continue to apply.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT YOUR DATA WILL NEVER BE LOST, OR THAT USING IT WILL PRODUCE ANY PARTICULAR RESULT.

Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, DC LABS, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR FOR ANY INJURY OR HEALTH OUTCOME, ARISING FROM YOUR USE OF THE SERVICE, ANY CONTENT IN IT, OR ANY PRODUCT YOU BUY THROUGH A LINK IN IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.

Some places do not allow these limits, so some of them may not apply to you.

Indemnification

You agree to defend and hold harmless DC Labs, LLC from any claims, losses, or costs, including reasonable attorneys' fees, that come from your misuse of the Service, Your Content, or your violation of these Terms or the law.

Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. Any dispute about these Terms or the Service will be handled only in the state or federal courts located in Colorado, and you and we agree to those courts' jurisdiction. Before filing a claim, please email support@asndfitness.com so we can try to resolve it informally.

Changes to these terms

We may update these Terms from time to time. If we make significant changes, we will let you know in the app or by email before they take effect. Continuing to use ASND after changes take effect means you accept the updated Terms.

General

These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a part of these Terms, we are not giving up our right to do so later. You may not transfer these Terms to anyone else; we may transfer them as part of a merger, acquisition, or sale of assets.
